"An effective compliance program requires continuous oversight and revision." said Kevin Delli-Colli, the Acting Assistant Secretary of Commerce for Export Enforcement. "Failing to keep pace with changing business practices can result in numerous violations and degrade our system of export controls."

U.S. Government Officials clearly have shown that they consider a compliance manual (program) a factor in whether or not to charge a company with a violation!

Federal Sentencing Guidelines allow a court to consider an effective compliance program (manual) in mitigation!

The Following Factors compose a strong compliance system.

(The nine points are Excerpts from the Enforcement Keynote Address by the Assistant Secretary, Darryl W. Jackson at the BIS Export Control Forum on March 17, 2008 in Newport Beach, CA)

1. Perform a Meaningful Risk Analysis.

2. It is Imperative that you have a formal written compliance program!

3. Appropriate senior organizational officials are responsible for overseeing the export compliance program.

4. Adequate training must be provided for employees.

5. A company must adequately screen their customers and transactions.

6. Your company must meet the compliance program's record keeping requirements.

7. The existence and operation of an internal audit system for reporting Import / Export violations must be in place.

8. Your company must keep on file the documented results of internal / external reviews or audits.

9. Proof of remedial activity that has been taken in response to import/export violations.

You are at legal risk without the above factors being addressed!
